Abstract

According to Islamic law, also breast milk creates a continuous ban to the marriage like consanguinity and marriage relationship. Although Islamic law, with verses and hadiths, always and clearly notes that marriage is prohibited during breastfeeding, it gives place in a limited way to conditions under which a prohibition of marriage occurs. Due to the variety of hadiths and different interpretations of verses, conditions identified by the nas1 are disputed, as well. Both our classical sources and many of the recently carried out academic studies analyse the marriage ban depending on the breast milk without systematisation and nas (verse and hadith) and sisterhood of milk was identified according to their knowledge of Islamic law and level of the scientific knowledge and jurisprudence methods. In this article marriage ban due to breast milk was examined systematically in terms of mother, milk and children. During the study the supposedly occurence of the marriage ban by dropping breast milk to the eye, ear and nose is evaluated in the classical data sources together with the verdicts of the anatomy of modern medicine, pharmacology, chemistry and food engineering. Besides, such as nasogastric catheter and percutaneous endoscopic gastrostomy new feeding patterns were researched whether they make up a ban to the marriege or not. In addition, adding medicine, water and food to the breast milk, mixing the mothers' breast milk and making yoghurt or similar food from the breast milk are analysed according to classical sources and recent and modern scientific studies. Today's studies have revealed that prohibitions on marriage in breastfeeding should not be determined according to the amount in the mix. This interpretation is valid for mixes where the structure of breast milk is maintained or changed.
