Abstract

The paper analyzes the approaches to the definition of the category “bank regulation” in the direction of defining its substantive aspects and approaches to the implementation. Despite the fairly extensive study of the problem of bank regulation and approaches to its treatment are wide and vary in the functional aspect of the identification of bank regulation with a set of management functions of the banking activities undertaken by the central bank, to the identification of bank regulation with oversight function. A comparative assessment of the categories “banking regulation” and “banking supervision” is given. The substantive aspects of banking regulation in the post-crisis stage of economic development are investigated. A significant methodological limitation of theories of banking regulation is their isolation from the institutional features of the control system, as a rule, their findings relate to either the state of the banking system as a whole or individual banks. Explored is the functional structure of banking regulation in the context of overcoming the consequences of the financial crisis. Modern researchers stress on deposit insurance, capital requirements, the implementation of anti-crisis policy and policy regard-ing the closure of banks, the implementation of the function of lender of last resort. The ways of improving banking regulation in terms of ensuring interactions between banks and enterprises credited to achieve synergistic effects on their relative performance and the socio-economic impact in the region are grounded. Especially, it is important for Donetsk region, where large amounts of industrial and financial capital are historically concentrated in one area. Therefore, this fact must be taken into account when developing the appropriate regulatory measures.
