LEGAL MODEL OF REMOVING OBSTACLES TO TRIAL OF A CRIMINAL CASE

With the introduction of Article 237 of the Code of Criminal Procedure of the Russian Federation into the Russian legislation, disputes related to the application of the procedure for the return of a criminal case to the prosecutor remain unchanged. From the analysis of the amendments, it was concluded that the legislator gives more accusations to the prosecution that the institution for the return of cases for an additional investigation has in fact been revived, but is called a return to eliminate the obstacles to consideration. In this connection, a model for reforming this institution has been developed.
