THE REVIEW OF THE RETROSPECTIVE SHOW OF DEVELOPMENT OF SUCH INSTITUTES, AS: RIGHTS AND FREEDOMS OF THE PERSON AND LIMITATION OF RIGHTS AND PERSON'S FREEDOMS - BY THE EXAMPLE OF THE INSTITUTE OF STATE OF EMERGENCY: THE QUESTIONS OF THE THEORY AND PRACTICES

In article historical analysis of development of institutes of human rights and their limitation was conducted. On the examples of experience of England and France and was shown of development of human rights institute how, attitude to it changed. By the example of Russia in different ages it was shown of change of the institute of state of emergency through comparison of the legislation. By the example of Russia that was shown to what consequences can lead by abuse of right to limitation of human rights during state of emergency. Conclusion is made regarding deficiencies of today's situation in the legislation of Russian Federation.
