THEORY AND PRACTICE OF THE RECOGNITION OF A LIFE CARE CONTRACT AS VALID

The article is about the possibility to recognize a life care contract as valid according to the civil legislation of Ukraine. It is defined, that state registration of rights has been constituted instead of official registration of contracts for now, so it is possible to find life care contract valid, when it has been settled in contravention of the requirement of law to fulfill its notary certification. It is underlined, that herewith the concerned party has to submit documentary evidence to prove the fact of agreement on all essential conditions of a contract, the fact, that the contract has been fulfilled completely or partially and the fact, that one of the parties has evaded its notary certification. It is concluded, that in such cases courts also take into account testimony of witnesses except documentary evidence.
