Abstract
In accordance with the principle of freedom of contract embodied in civil law, the parties have the right to freely enter into an agreement, choose a contractor and determine the terms of the contract, taking into account the requirements of the Civil Code, other acts of civil law, business practices, and the requirements of reasonableness and fairness. Of course, there are limits to this freedom, but they still remain a controversial issue among many scholars and require careful study and generalization.
