O ART.42(1) DA CONVENÇÃO DE WASHINGTON 1965: A ESCOLHA DO DIREITO APLICÁVEL NA ARBITRAGEM SOBRE INVESTIMENTOS INTERNACIONAIS REGIDOS PELO ICSID

What is Choice of Law under the ICSID? In search to an answer to this question, the present study analyses the application of §42(1) of the Washington Convention 1965 by the International Centre for Settlement of Investment Disputes (ICSID) and the different questions that arouse in his arbitral tribunals, in special: (1) the meaning of choice of law under §42(1); (2) how to ifind the implicit chosen by the parties; (3) the role of Conflictr of Law rules and (4) the role of (General) International Law in the matter.
