Abstract
This paper endeavours to explore what, if any, is the role of international instruments in the way of establishing the standards of patentable subject matter. To do so, an examination of protected methods of medical treatment will be used as a baseline example. In re-examining the patentability of medical treatment methods and the role or lack thereof of international instruments, Agreement on Trade-Related Aspects of Intellectual Property will be reviewed.
