Abstract
The penal provision, like any procedural action, must meet several conditions in order to have its legal effects. The penal provisions are divided in terms of their validity into correct and defective provisions. The validity of the penal provision requires certain conditions for acquiring this class. The ruling is null and void, such as the court is not legally formed.
The nullity shall not affect the defective penal judgment as soon as the procedures are violated, but the judgment shall remain valid and produce all its effects until it is determined by a judicial decision issued by the competent court of whatever type of invalidity.
