Abstract

The article examines criminological aspects of medical crimes, which, besides "traditional" iatrogenic crimes, cover a number of other risks of using these technologies for criminal purposes. The materials for the study were the results of the authors own observations and theoretical studies, the data obtained by analyzing information on the research topic for 2012-2017, the data of the analysis of the medical and judicial practice, the data of sociological jury of opinion - medical workers of various profiles, whose professional activity is directly related to the use of biomedical technology (280 people). The social and legal status of the medical worker determines the potential possibility of using appropriate skills, skills, competencies, official position and authority to commit crimes in the sphere of their professional activities. Retardation of the legal regulation in the sphere of biomedical technologies generates the possibility of committing socially dangerous acts by medical workers and the so-called "gray areas of responsibility", which significantly affects the potential of using these technologies for criminal purposes. The author emphasizes the fact that the risks of criminal use of biomedical technologies by medical workers should be considered not only from the perspective of the current established medical and legal practices, but it also should take into account the potential of biotechnological development of medicine in the future.
