Abstract

Normatively, the constitution guarantees the protection of the holders of land rights to the land it owns as stipulated in Article28 H paragraph (4) and Article 28 J paragraph (2) of the NRI Constitution of the Year1945.Land acquisition for the public interest often cannot run well, because land holders are reluctant to relinquish their land, because they feel they have not received proper compensation.Therefore, to realize the values of justice there is a need for several means of settlement, such as the mechanism of deliberation and compensation mechanisms.The ideal concept of land development for public interest is not by buying and selling but by releasing rights or revoking rights along with compensation based on the sale price rather than based on the selling value of the tax object.Determination of the value of fair compensation can also be seen as legal recognition and legal protection of land rights holders while taking into account the social functions of land.The reconstruction is done against Article 6 BAL, ie all land rights have so s ial function, with the protection of individual ownership.
