CRUELTY TO ANIMALS: DETERMINATIONS OF CRIME

Abstract
The study carried out the complex analysis of publications on the issue of general determination and legal cruelty with animals in particular, since the latter are part of a system of determinants of crime in general and in turn include determinants of other types of crime. It is noted that this issue is quite new for Ukrainian criminologists, instead, which led to a rather active scientific activity of Russian scientists; it is determined which causes and conditions contribute to the commission of such an offense as legal cruelty with animals, which is one of the key factors in improving the effectiveness of crime prevention. One of the main theses of this publication is that, criminality related to legal cruelty with animals, as well as specific crimes, in any society is social in nature, that is socially determined. Therefore, when determining the determinants of this crime, it is suggested to take into account the immediate environment, family and school factors. On the example of real life situations it is shown that not anomaly of the psyche determines the commission of a crime related to legal cruelty with animals, but that education, those unfavorable terms forming of individual, that gave a push for criminogenic personality traits. Such anomalies can contribute to their occurrence and development, as well as the most unlawful behavior, but only as a condition that does not determine this behavior in general. Consequently, the formation of criminal motivation to legal cruelty with animals has a complex nature, which is the main difficulty of knowing its determinants.
