Abstract
The article covers the ancient customs of war, which continue to develop until today, only on a more qualitative level. Based on the recommendations of the International Committee of the Red Cross on the improvement of Ukrainian legislation in the field of international humanitarian law, the article outlines the basic principles that should guide the parties to an armed conflict in the course of hostilities. Each principle is considered separately in the understanding of the Committee, as well as in the doctrinal interpretation for practical application. Also, the work outlines how such principles are enshrined in domestic legislation. At the end of the article, a comparison of the norms set on the national and international levels is presented.
