PROBLEMS IN CONDUCTING LAND MANAGEMENT IN AGRICULTURAL ENTERͳ PRISES IN THE PROCESS OF LAND REFORM

Abstract
The analysis of the land management of agrarian enterprises in the process of land reform is carried out. A number of problems, related to the imperfecƟon of the insƟtuƟonal environment of the land management and the land use of modern agro-formaƟons, have been idenƟfied; incompleteness of economic and legal ownership relaƟons between land owners and agricultural structures, delay in the development and adopƟon of normaƟve legal acts, required for further reformaƟon of land relaƟons, and catastrophic reducƟon of the volume of land management works aimed at ensuring raƟonal land use are among themIt is found that the most important of these problems are the absence of a scienƟfically substanƟated and legislaƟvely established Strategy for the formaƟon of a raƟonal system of land tenure and land use aimed at creaƟng a favorable environment for sustainable rural development, the lack of the effecƟve funcƟoning of agricultural enterprises, and an increasing role of land management in ensuring environmentally safe use of land resources in agricultural producƟon. The soluƟon of the above problems implies improvement of the legal framework for regulaƟon of land relaƟons, in parƟcular, regarding the legislaƟve definiƟon of the administraƟve status of the united territorial communiƟes; demarcaƟon of state and communal property lands; consolidaƟon and prevenƟon of further subdivision of agricultural land allocated for agricultural producƟon. The necessity of the development and adopƟon of the NaƟonal Program of Land Use and ProtecƟon, as well as the necessity of amending the Land Code of Ukraine and the Laws of Ukraine “On Land Management” and “On Land ProtecƟon” is substanƟated.
