MURDER FOR PART 1 OF ART. 115 OF THE CRIMINAL CODE OF UKRAINE AND MURDER UNDER ART. 119 OF THE CRIMINAL CODE OF UKRAINE AS DIFFERENT LEGAL PHENOMENA

The article examines the legislative definition and essence of the concept of "murder", reveals its features under part 1 of Art. 115 of the Criminal Code. The intentional "simple murder", and the deprivation of life through negligence are compared . The attention is paid to the legal mistake of the legislator in determining article 119 CC of Ukraine and it is noted that such a legal error leads to a misunderstanding of the contents of the law and errors in the practice of its application. Proposed changes to article 119 CC of Ukraine.
