Abstract

The article is devoted to the analysis of new tasks and possibilities of regulating the relations and rights of co-owners in the formation of joint ownership objects and the implementation of residential real estate management functions. The general concept features of real estate in relation to residential real estate are analyzed. The specific manifestation of the models of a single real estate object and multy objects β€” a land plot, a house, non-residential premises and apartments in condominiums are considered. The differences in understanding the objects of joint ownership are shown. Models of direct and indirect ownership and approaches to their application at various facilities are systematized, which is caused by the emergence and owner's and management necessity to carry out management functions of varying complexity with corresponding costs. Separation of residential property by complexity has been carried out: single-family houses, condominiums and enterprises. The possibility of combining the rights of individual and common ownership of objects in the implementation of residential real estate management has been thoroughly investigated. The dependence of the legislative definition of the concepts of real estate and property under consideration on historical and socio-economic circumstances and the need to regulate housing ownership relations in Ukraine has been shown. Taking into account the imperfection of the current legislation and property relations in the management of multi-apartment buildings, the legal and economic feasibility of applying country-specific several legal and managerial structures is justified which provide the needs for the formation of effective co-owners with the implementation of separate or complex rights of possession, disposal and use of various real estate properties, and separate β€” land, building, premises. The models of relations and property rights in residential real estate has been proposed.
