ANALYSIS OF THE GENESIS OF THE NEW PROVISIONS OF THE CRIMINAL CODE OF UKRAINE OF CRIMES AGAINST SEXUAL FREEDOM AND SEXUAL INTEGRITY

This article substantiates the relevance of the proposed topic. It was analyzed the development of these items in the Сriminal Сode of the Ukrainian SSR from 1960 till new editions to Сriminal Сode of Ukraine from 2001 which was adopted in 2017. It should be noted that in reforming criminal legislation is necessary to pay attention not only to the International experience and the experience of laws in other countries but also the practice of the European Court of Human Rights. Each article of the special part 4 of the Criminal Code has been analyzed separately and the positive and negative aspects of the crime characteristics are indicated Innovative ways of further adaptation of national criminal legislation to international conventions and definitely priority goals overcome the remnants of the Soviet paradigm of antisocial Criminal Law in the context of crimes against sexual freedom and sexual integrity of people are proposed.
