FREELANCE AS A FLEXIBLE FOR OF EMPLOYMENT IN UKRAINE: THE STATE AND PROSPECTS OF DEVELOPMENT

Abstract

In the topical issues of article were analysed application in the modern world of such flexible form of employment as freelance. It is considered features of origin of freelance in Ukraine and the prospects of its further development. Special attention is paid to freelance use by certain categories of workers: persons with disability; elderly people; persons who combine work with study, etc. Authors formulated definition of «freelance», the difference between such concepts as «outwork», «remote work» and «freelance», and analysed their definitions in the legislation and process of formation. It is also analyses foreign experience concerning regulation of this sphere of the relations, in particular experience of the United States of America and the countries of Europe. It is defined in which countries the matter is regulated by labour law, and in which by the civil legislation and which consequences it involves and in what way these relations are settled. It was analysed that regulation by the labor law has advantages in regulation by civil law, and entering into a employment contracts has advantages in entering into a turnkey contracts and also interests of workers as economy propellers in this question to obtain social guarantees and social protection, opportunity to join trade unions, receive social benefits, etc.. It is also analysed the Ukrainian legislation, the history of regulation of the similar relations and modern regulations. Shortcomings of legal regulation of these relations and the offered changes were analysed to improve a situation and to fill gaps. It was made the analys of cyber security in Ukraine, the bodies authorized for implementation of such control, their competence, shortcomings of such bodies. It is offered to increase competence of similar bodies or to create new effective regulation of this sphere. It is offered to set up cooperation with the leading states in this sector for more effective introduction of these mechanisms, in particular with Estonia. On the basis of the full analysis authors offered the vision of the solution of the matter to promote in consensus interests, both workers, and employers.
