Abstract

The scientific article is devoted to the study of the legal doctrine and legal framework of public administration of the judiciary, the definition of its institutional system and status, functions, powers, duties, rights and responsibilities of employees of judicial institutions. The own theoretical definition of "public administration of the judiciary" has been formed. An attempt is made to form the institutional structure of the judiciary with a specific hierarchical structure, which has a purposeful activity, forms goals, works on all elements of the judicial system and makes management decisions. It is determined that the legal status of court staff has specifics and is an extremely complex subject of study. Under the legal status of an employee of the court proposed to understand the statutory rights and responsibilities of the subject - the holder of this status, which has a special procedure for formation, appointment or election to his position, belongs to the judiciary, but does not directly administer justice, and provides appropriate conditions for the proper and equal access to justice. It has been proven that the powers, duties, rights and responsibilities of the judiciary are currently branched and unclear. Therefore, it is proposed at the legislative level to develop and adopt a special legal act, which clearly defines the status, functions, powers, duties, rights and responsibilities of the judiciary. After analyzing the status, functions, powers, duties, rights and responsibilities of employees of judicial institutions, we concluded that they include employees of court staff, which provide organizational support for the work of the court, provide appropriate conditions for equal access to justice and judges timely, reasoned decisions in cases, establish the general purpose of the court staff and determine the procedure for interaction with the judiciary, other systems to ensure the functioning of the judiciary.
