ACTUAL ISSUES OF MINORS’ CRIMINAL RESPONSIBILITY IMPROVEMENT

The Constitution of Ukraine declares the desire of our people to build a legal state. However, achieving the goal is impossible without a qualitative reform of the legal system of the country, which still has remnants of Soviet law. Integration of Ukraine into the European community is not possible without fully aligning national legislation with the generally recognized European standards and international postulates in juvenile, as well as borrowing the most effective forms methods, measures and means that were proved their reliability by world practice in the field of prevention and concentration to delinquent behavior. In the article according to the theoretical concepts and opinion was considering a specificity of criminal responsibility of minors. Authors suggested the several way of deciding this problem that based on own research, analyze of Criminal Code of Ukraine, judicial practice, national statistic of criminal offences, international practice and standards to national legislator. Also the criminal law of foreign counties were analyzed and differences between of minimal age of criminalization by comparing with CIS countries. Moreover, current statistic of juvenile delinquency based on justice indicators, Report of Prosecutor General`s Office of Ukraine about amount of committed criminal offences in the past years. In general, the problem of juvenile delinquency that remains actual for the entire world community that is concerned about development better approach to resolving this problem was discovered by authors in their own opinion. On the one hand, approach described in the article consist of combination of humanism and efficient ways of preventive influence, on the other hand it excludes repressive influence.
