Abstract

The concept of human rights and freedoms has a multifaceted manifestation, and the importance and necessity of its development and promotion in the modern world is difficult to overestimate. The perception and understanding of the essence of the concept of human rights and freedoms in the philosophical, legal, historical aspects depends on how the further development and functioning of this society will take place. The article investigated the legal aspect of human rights and freedoms is a system of norms that establish and regulate human rights, a set of bodies and procedures aimed at their protection, which are of particular importance in the study and further implementation of human rights and freedoms both nationally and internationally. At the same time, domestic and international law from the beginning of the historical development of the concept of human rights and freedoms have had a mutual influence, enriching and complementing each other. As in while, the norms governing human rights and the mechanisms for their protection are clearly defined at the international legal level today, which is why states that undertake appropriate obligations to protect the rights and freedoms of citizens must bring their own national legislation into line. In this regard, special attention is paid to the establishment of national human rights institutions, ie bodies that perform general and specific functions for the protection and promotion of human rights. At the same time, the constitutions of most countries enshrine the priority of universally recognized principles of international law for the protection of human rights and freedoms, so in addition to domestic legal guarantees, there are also international legal guarantees of human rights and freedoms. As a result, a citizen of a state has the right, after the application of all national remedies, to apply for protection of his rights and freedoms to the relevant international organizations. The activities of such institutions are carried out by mutual consent of several states, formalized and carried out within the framework of an international agreement, which defines their powers, rules, special procedures.
