JUDGES ‘RESPONSIBILITY FOR CORRUPTION OFFENSES: A PRACTICAL ASPECT

Abstract

Reforming the judiciary and building the rule of law requires achieving a high level of law enforcement, implementing institutions of responsibility and following the principle of equality before the law. The issue of the responsibility of the judiciary becomes a priority due to the special status, level of responsibility and importance of judges in the context of the rule of law, the rule of law, fair litigation and the settlement of public relations. The article highlights the positions that reveal the legal aspects of bringing judges to justice for corruption offenses. Peculiarities of formation and manifestations of corruption in the activity of judges in Ukraine, types of liability applied to violators of anti-corruption legislation are considered. Emphasis was placed on the inevitability of sanctions for neglecting the requirements of anti-corruption standards and rules. It is determined that the three main types of liability include disciplinary, administrative and criminal. Despite the application of a special procedure of procedural measures to the servants of Themis, judges are prosecuted on general grounds. The current legislation governing the administration of justice imposes on judges the obligation to comply with anti-corruption legislation, notification of the existence of circumstances that affect the impartiality and independence of the judiciary. The urgency of a quick and effective response to corruption committed by judges is outlined in the main strategic documents on the development and functioning of the justice system, which necessitates further work and generalizations on the issues raised. Overcoming corruption in the judiciary remains one of the most significant problems that accompanies the process of reforming and improving the judiciary in Ukraine.
