Abstract

Liability of producers of goods is a branch of civil liability that in terms of basis has gone through several stages, starting from the basis of contractual liability and ending with the basis of pure liability. In this article, the data of which has been collected by descriptive-analytical method as well as by library method, in order to protect the rights of consumers against the damages that may be caused to them as a result of using defective products and goods, we seek to obtain a basis to protect the rights of consumers and place the responsibility for the production of defective goods on the producers of such goods. Among the many basics that exist regarding the protection of consumer rights against producers of defective goods, the basis of pure liability seems to provide the greatest protection of consumer rights, because according to the mentioned basics, consumers are not required to prove the defective goods producers' negligence, incaution or - in other words - their guilt in order to hold them liable, and the consumers only need to prove that there was a defect in the goods at the time of production of the mentioned good in the factory and that they have been damaged due to the said defect.
