Abstract

The article analyzes the aspects of criminological characteristics of a person who commits legalization (laundering) of property obtained by criminal means. The importance of the identity of the offender plays a leading role in the process of determining crime, a set of measures to prevent and shape the criminological policy of the state. The need to study the criminological characteristics of the offender, whose actions are related to the violation of state social standards in the process of illegal money laundering, due to the fact that taking into account its properties helps to effectively combat such crime. This characteristic provides an opportunity to correctly solve problems of individual responsibility and punishment, to identify the causes and conditions that affect the commission of the analyzed type of crime. Despite the growing trend of legalization of criminal property, current legislation and the science of criminological law leave open a number of issues and this state of affairs contributes to ambiguous understanding of the identity of the offender under investigation, resulting in different legal assessments of money laundering. The views of domestic and foreign criminologists who in their scientific activity actively considered, researched, studied, analyzed the personality traits of the offender are considered. The peculiarities of socio-demographic, personal-role, moral-psychological and criminal-legal characteristics of the offender are studied, because these components in combination are important for productive and effective analysis of factors of criminal behavior, provide a thorough and comprehensive definition of crime and true guilt persons. A criminological portrait has been formed — specific personality traits are described, which are inherent in such a layer of criminals who commit money laundering.
