BAIL PROCEDURE IN INDIA: AN ANALYTICAL STUDY

Abstract
Right to bail is absolute in case of bailable offence. It has been suggested that where a person is released on bail, has absconded or has failed to appear before the Court on the date fixed, he will not be qualified for bail when brought to Court on any ensuing date The word indigent means that a person admitted to bail in bailable offence is unable to give bail within a week of the date of his arrest, and hence the Court shall presume that such person as indigent.
