Abstract
The foundation of the Indian democratic government is its Constitutional Law. The constitutional law is the groundwork on which the civil liberties, obligation and responsibilities of each individual lies, whether they are the people or representatives of the peoples. The Supreme Courts uses these constitutional provisions to safeguards the rights of the citizen , it's a sword in the hands to Supreme Court to be used against the sovereign, when it intrudes with the rights and authorizes granted to it , thereby infringing the due and legitimate rights of the individuals .Constitutional morality comes into action to ensure that all the constitutional provision are practiced
