FIDIC Kırmızı Kitap Kapsamında İnşaat Sözleşmelerinde Süre Uzatımı

In construction contracts, which are part of our daily life and have great economic value, time for completion is an important element of the contract. Due to this importance, it is observed that construction contracts signed by the parties regulate the time for completion, liability for delay damages and under which circumstances claims for the extension of time for completion and additional payment may come to the fore. Since the constructions are mostly the big projects where many firms work together, provisions, including the time for completion, to solve the possible problems that may arise during the project are included in the contract. In this context, standard rules determined by the FIDIC are widely adopted in construction contracts. The focus of this study is the Red Book which sets forth the conditions of contract for construction and of which the updated version is published in 2017. This study will examine the concept of time that the contractor has to fulfil his/her performance in accordance with the construction contract and rights and obligations of the contractor and of the employer in the Red Book 2017 when the construction is not completed within the agreed time. Finally, the extension of time in construction contracts will be discussed within the framework of the Turkish Code of Obligations.
