ADMINISTRATIVE AND LEGAL STATUS OF JUDICIAL BODIES AS SUBJECTS OF PROTECTION OF THE RIGHTS OF CITIZENS TO A SAFE ENVIRONMENT FOR LIFE AND HEALTH IN UKRAINE

The article analyzes the administrative and legal status of judicial bodies as subjects of protection of citizens' right to an environment safe for life and health in Ukraine. Particular attention is devoted to the definition of the constituent elements of this status, its characteristic features. It was established that the administrative-legal status of judicial bodies as subjects of protection of the right of citizens to an environment safe for life and health in Ukraine is a set of administrative-legal features that determine the place of judicial bodies in the system of environmental legal relations, determine the target, organizational, competent the ability to implement the protection of the citizens' right to an environment safe for life and health is a reflection of his rights, duties, guarantees of activities regarding the protection of citizens' environmental rights. The peculiarities and structure of the legal personality of judicial bodies as subjects of protection of the right of citizens to an environment safe for life and health in Ukraine are determined. The competence of judicial bodies as subjects of protection of the right of citizens to an environment safe for life and health in Ukraine is characterized. It was established that it transforms the rights and responsibilities of these institutional entities into a coherent system determined by sub-department, target orientation of the main tasks, organizational structure, etc. As a result, the ability and readiness to exercise human rights influence in order to protect the right of citizens to an environment safe for life and health is formed. It was established that all elements of this status in their interaction form the state-guaranteed ability and readiness of judicial institutions to prevent and stop illegal activities aimed at violating the right of citizens to an environment safe for life and health in Ukraine. Special attention is devoted to guarantees of the activity of courts as subjects of protection of the right of citizens to an environment safe for life and health. It is substantiated that the calculation of the specifics of court cases related to the protection of the right to an environment safe for life and health prompted individual states to form a system of environmental courts.
