ORGANIZATIONAL AND LEGAL REGULATION OF THE RESTORATION OF THE DAMAGED CONSEQUENCES OF ARMED AGGRESSION INFRASTRUCTURE AND INTERNATIONAL LOGISTICS CONNECTIONS OF UKRAINE

Abstract

The article examines the harmonization of current standards of the infrastructure sector of Ukraine with EU policy, as well as the state of organizational and legal regulation of transport and infrastructure relations and their transformation after the start of full-scale enemy aggression. It has been established that it is expedient to form an updated organizational and legal paradigm for the restoration of the infrastructure of our state and interstate logistics connections through the implementation of national and international infrastructure projects. The organizational and legal powers of state executive bodies (Ministry of Infrastructure, Ukrinfraproekt) implementing state policy in the field of development, construction, reconstruction and modernization of the country's infrastructure were studied. It has been established that there are clear administrative prescriptions regarding the implementation of infrastructure projects in Ukraine during the period of martial law during the post-war reconstruction of the infrastructure of the affected regions in the regulatory and legal acts (regulations on the Ministry of Infrastructure and the Ukrinfraproject, the National Transport Strategy of Ukraine). It is proposed to adopt the National Strategy for the restoration of regions, territories and infrastructure affected by armed aggression. Its main tasks are defined: priority restoration of the social infrastructure of the de-occupied and affected territories; restoration of transport connections between cities, including railway and road infrastructure; increasing the export logistics potential to preserve the functioning of the economy, etc. It was determined that it is necessary to form a fund of monetary resources under the direct control of the CM of Ukraine (including by attracting the resources of foreign financial partners) as the main source of funds for the infrastructural revival of Ukraine, as well as the identification of Ukrinfraproject as the state coordinator of this process.
