DIRECTIONS FOR IMPROVING THE EFFECTIVENESS OF THE INSTITUTE OF LEGAL RESPONSIBILITY OF JUDGES IN UKRAINE

Today, there are many problematic aspects that directly relate to practical issues related to the organization of judges' activities and the functioning of the judicial system in Ukraine. One of the key issues in this direction is the specifics of the conduct and content of the judicial reform of Ukraine. It was determined that today one of the important aspects in this direction is the determination of directions for improving the effectiveness of the institute of legal responsibility of judges in Ukraine. Based on the results of the research, general conclusions are formulated, and theoretical and practical proposals are also presented regarding a new solution to certain scientific and practical problems that relate to directions for improving the effectiveness of the institute of legal responsibility of judges in Ukraine. In particular, it was found that an important mechanism for preventing and combating offenses among judges is a special check of candidates applying for the position of judges (during their selection), as well as judges during their transfer, qualification assessment or when elected to a position for an indefinite period. It is also stated that the appropriate level of material and legal support of judges is a stimulator of conscientious performance of their professional duties, for the lawful behavior of judges (each individual judge). Lowering the achieved level of remuneration (official salary) of judges and/or their pension: leads to a violation of the constitutional principle of independence of judges; is a factor that directly affects the propensity of judges to corrupt acts and/or misconduct. At the same time, it is recommended to develop a special law on the legal responsibility of judges, which should provide for the following basic aspects: the limits of personal legal responsibility of judges; concepts and types of legal responsibility, mechanisms of their support; as well as types of punishments for actions and/or irresponsibility of judges. It was determined that further research should be conducted in the direction of studying practical issues regarding the criteria and methods of evaluating the effectiveness of the judicial system in Ukraine.
