PRINCIPLES OF LEGAL OBLIGATIONS OF UKRAINE WHEN CONCLUDING INTERNATIONAL TRADE AGREEMENTS

Abstract

In the Latin language there is the word «principium», which in translation means the beginning, the basis. It is natural that this term is actively used in science, in particular legal, where it means the initial position of a scientific system, as well as a peculiarity that is the basis for creating something [1]. This article reflects the principles of international trade agreements concluded by countries as subjects of international trade relations. I researched about 100 international trade agreements of Ukraine in the field of trade and economic cooperation, as a result of which a conclusion was drawn about the nature and peculiarities of these relations. They were outlined by me in the following principles, which states must adhere to when concluding international trade agreements, namely the principles of: voluntariness, binding obligations, sovereign equality, good faith performance, equal understanding of mutual obligations, justice. I am convinced that the above-mentioned foundations are basic and characterize interstate cooperation regardless of the foreign policy courses of each individual country. Taking the principles defined in the article as a basis will enable not only scientists to carry out a qualitative analysis of international trade agreements of Ukraine in the future, but also representatives of delegations to correctly conclude agreements in order to minimize the risks of non-fulfillment of certain parts of the agreements by the contracting parties. I believe that the following study is undeniably relevant in the context of European integration and close trade cooperation of our state with other subjects of international public law.
