THE ROLE OF A LAWYER IN THE CASES OF CORRUPTION OFFENSES

Abstract

Introduction. In the contemporary world, corruption remains one of the most acute issues affecting justice and trust in state institutions. The legal profession, as an essential component of the legal system, plays a pivotal role in combating this phenomenon, ensuring the protection of the fundamental rights and freedoms of citizens. The role of lawyers in cases of corruption offenses is particularly important as they not only protect their clients' interests but also contribute to ensuring transparency and fairness in judicial processes. Lawyers as participants in legal relationships possess a series of professional guarantees that ensure their independence and effectiveness. Anti-corruption guarantees of legal activity represent a system of measures aimed at ensuring transparency, independence, and integrity in the professional activities of lawyers. The main goal of these guarantees is to prevent the influence of corruption and other improper actions on the resolution of legal issues. This includes ensuring independence from external influences that could distort impartiality and objectivity in their decisions. Purpose. The purpose of this article is to identify the impact of legal activity on the protection of clients' rights in cases of corruption offenses, as well as on the processes of detecting and countering corruption, particularly how lawyers can contribute to the transparency of judicial proceedings and the strengthening of the rule of law. Materials and Methods. The research materials include: 1) normative legal regulation of legal activity; 2) works of domestic and foreign authors dedicated to anti-corruption and legal activity. The study employed the hermeneutic method or the method of interpreting legal norms to accurately clarify and explain their essence, as well as formal-logical procedures (ascending from the abstract to the concrete and vice versa). Results. Thanks to anti-corruption guarantees, the legal profession strengthens public trust in the legal system, promoting the formation of a rule-of-law state where every citizen can expect their rights and freedoms to be protected in a fair and unbiased judiciary. The conclusions of this article emphasize the need for further research into the role of the legal profession in anti-corruption processes and the need to develop new methods to strengthen legal mechanisms for protecting citizens' rights. The importance of legal work in cases of corruption offenses lies not only in protecting individual rights of clients but also in influencing the overall legal climate in the country. For this reason, lawyers often find themselves at the forefront of the fight against corruption, using their knowledge and skills to detect and counteract corruption schemes at all levels of power. The proposed study underscores the importance of professional responsibility for lawyers and their obligation to work according to high ethical standards, which are fundamental to countering corruption in modern conditions. Discussion. Corruption poses a challenge not only to the rule of law and the legal order based on this principle but also to the legal profession as a whole, as the absence of effective guarantees for preventing and countering corruption can lead to its spread among lawyers. Therefore, we must closely monitor the development of best practices for countering corruption worldwide, welcoming comparative research that can enhance the impact of anti-corruption reform in Ukraine.
