Abstract
The reseach deals with the importance of the principle of the Effectiveness of Recognition of human rights for the observance of democracy. The aspiration of the countries to the democratic society can provide minimum restriction of Conventional Human Rights and mean their maximum effectiveness in the establishment of democracy. In the focus of attention is the legal nature of the principle of the effectiveness of the defence of human rights ? these rights ara effective only when they are aimed at the development of democracy. The dynamics of the principle of the effectiveness of the rights has been analyzed: to make conventional law promote the establishment of democracy, the state is obliged to take effective astions to provide real freedoms (not illusory ones). It has been proved that any even legal intrusion of state into conventional right must be adequately protected to prevent any withdrawal from democracy.
