Abstract
The article gives a general description of the negotiation process. It reveals the nature of the negotiations as an alternative form of dispute resolution and confl ict. the functions and subjects of the negotiation process are allocated. The distribution function of the negotiation process contributes to the formation of a closed system. Notes that participation of civil society groups has a positive impact on the concluded agreement, revealed the nature of the negotiating process. Describes why the talks are an effective way to resolve the dispute, noted the importance of prevention. It is clarifi ed that the negotiations are unregulated by law procedure that extends the boundaries in dispute resolution
