Abstract

Problem setting. Since 2004 the course of European integration and the creation of a highly developed country with a competitive economy was fixed in Ukraine. June 27, 2014 Ukraine endorsed an Association Agreement with the EU to confirm its European choice, to promote reforms and to adapt national legislation to the EU. And January 12, 2015 President of Ukraine countersigned a decree “On the Strategy of Sustainable Development “Ukraine-2020”, the main goal of this Strategy defined as achieving European living standards and decent place in the world for Ukraine. Therefore, it would be appropriate to use the experience of the Member States to formulate the national legislation in scientific-technical and innovation field and to optimize the state policy in this area. Analysis of recent research and publications. The issues of EU innovation policy, and, particularly, special aspects of EU countries legislation in scientific-technical and innovation fields, and the influence of the EU legislation on the development of national law in the Member States have recently been the subject of researches of many legal scholars. In particular, Yu. Kapitsa, D. Zadyhaylo, Yu. Atamanova, S.Bereslavskiy, G. Androschuk, R. Ennan, B. Malicki, I. Silchenko, K.Shahbazyan and others. Target of research. The aim of the publication is to analyze the laws of the Member States in scientific-technical and innovation fields to use this experience in the formation and implementation of relevant national legislation considering current economic and geopolitical challenges. Article's main body. The author examined features of legislative framework of scientific-technical and innovation activity in the EU Member States, based on the analysis of legislation concerning with: - activities of universities and other higher education institutions; - technology and knowledge transfer; - intellectual property protection; - state support for research and innovation activity. This article focused attention on the national strategic programs in science and technology innovations fields, analyzed their objectives, priorities and tools for their implementation, examined the specificity of innovative programs financing and assessed possibilities provided by these programs. Conclusions and prospects for the development. Member States legislation on research and development and innovation regulated by set of tools and measures: national strategies and/or plans in research and development and innovation fields, legislation on the research sector and the universities activity, legislative on technology transfer, tax legislation and the annual budget legislation and legislation on the means of state financial support and other incentives for scientific-technical and innovation activity. Building of highly competitive universities that can accumulate and increase their own intellectual potential and generate intellectual capital of the nation, that can facilitate system integration of education, science and technology transfer and, on this basis, can provide international competitive advantages for the country ? is the determinant for EU innovative development activization. The focus on innovation in some universities fundamentally changes the status of these institutions at the global educational market and high-tech products market, making them key players in global innovation network. It is justified for Ukraine to develop the strategy of world-class universities. Higher educational institutions of Ukraine with the “research” status can make a competitive potential of higher educational institutions and with state support will enter to the rating of most contested universities in Europe. In most Member States the question of R&D and innovation activity financing received much attention as one of the main factors of innovation stimulating.
