LANd TITLES IN ECONOMIC ACTIVITY FIELd: PROBLEM OF dEFINITION

Problem setting. At the present stage of the market economy development in Ukraine, land becomes the main national wealth. The question of improving the legal mechanism of economic entities’ land property rights enforcement demands special consideration. Special provisions that establish the distinctions of the land titles enjoyment by business entities are absent in the economic legislation. Also, there are no unified scientific approach to determining the category of ?property right? and ?land? that leads to complexity in the using and disposition of such objects and may violate rights and interests of the participants of economic relations. Consequently, there is practical and theoretical necessity to analyze the category of ?land titles? and to establish the features of its implementation by business entities. Analysis of resent researches and publications. Category of property right, including land titles, is uncharted in the economic law. In fact, there is no scientific special analysis of property rights as object of economic relations. Detailed study of the concept of ?property rights? carried out in civil law. Scientific papers of I. V. Spasibo-Fateeva, S. I. Simon, A. S. Yavorsky, V. M. Ermolenko and others are devoted to the researches of above-mentioned issue. Target of research. To analyze the provisions of the economic, civil, land legislation and scientific approaches to determine the essence of land titles in the economic field. Article’s main body. The author analyzes the current economic, civil and land legislation and other laws that regulate property relations in the economic field. Different approaches to the definition and content of the legal categories of ?property rights?, ?real estate? as objects of property relations are considered in the article. It also concerning with the land as a kind of property (real estate). The various scientific approaches to determine the nature of property rights, including land titles of economic entities are studied in this article. Conclusions and prospects for the development. Above-mentioned gaps in economic legislation require immediate filling and resolving by making appropriate additions to the Civil Code of Ukraine. Namely the consolidation of special rules that establish the distinctions of the land titles realization by economic entities.
