ECONOMIC AND LEGAL REGULATION IN THE FIELD OF TECHNOLOGY TRANSFER

Abstract
In the majority of subjects, Ukraine in a competitive innovation development depends on the integration of innovation in the global technology transfer as an integral component. Transfer of technology concerning important state interests in economics, and has a significant impact on scientific, technical and socio-economic development of Ukraine. We know that the foundation of the modern economy is "knowledge" that is embodied in the "high-tech". More and more "knowledge" are keys to economic dominance of the highly developed countries in the world. Modern production is quite complex and high-tech. The appearance of new technological solutions, usually preceded, during the accumulation of knowledge that can push the known prior art. Ukraine has always been marked by a high level of scientific potential (Ukraine takes the 23d place according to the ranking by the number of patents (World Intellectual Property Indicators)). However, is observed paradoxical situation where the presence of significant results of scientific and technological activities, but the country is deficient in their use (implementation) in manufacturing, education, science, medicine, agriculture and so on. Of course, the level and quality of technologies that are used largely determine the country's position in the global hierarchy. Unfortunately, Ukraine continues to be among the most backward in the technological development of countries. This is according to the World Economic Forum (Report Global Competitiveness Report - ranking global competition for 20132014), Ukraine occupies 84 place. And the ranking that determines the level of innovation (The Global Innovation Index 2013), Ukraine seats 71 place. In this article the author examines the legal framework of the phenomenon of "technology transfer" in the problematic aspects of insufficient elaboration of the conceptual apparatus. Particular attention is paid to the problems of terminology and legal value of such concepts as "technology" and "technology transfer". Are formulated their signs. Transfer of technology is the basic form of innovation.
