Abstract

In the process of adaptation of Russian economy to a market economy aggravated the problems associated with the introduction of market circulation of results of intellectual activity. The level of protection of intellectual property ? the measure of civilization of any society, and the question of ownership is Central to the functioning of any market factor. Intellectual activity involves the maximum utilization of the total accumulated volume of knowledge and information, their increment and content of any work of intellectual component. The incentives for the intensification of intellectual activity is evident, as the traditional business scheme based on simulation, assuming a maximum return of resources and managing production volumes is on the brink of his exhaustion. Currently in the Russian economy, a situation when due to a sharp gap on key indicators in almost all sectors of the economy faced the problem of choice of development strategy. The existence of different variants and scenarios of Russia's withdrawal from the crisis, as proposed at the national level, due to the need to simultaneously address issues of ownership, technological safety of production, limited resources, financial unattractiveness for private investment. Russia has no alternative to innovative development. Historically, Russia is doomed to lag, if its development goes by the way of specialization in high technologies. Without a national science and scientific schools, their state support impossible. The creation of a prosperous economy in Russia is possible only when the forced development of high-tech industries. Innovative model of economic development assumes that the dominant early entrepreneurial schemes should be intellectual resources and commercialization of intellectual property. Today only use the results of intellectual activities in the real sector of the economy guarantees success in the domestic market and for export. The question remains about the legal protection and use of intellectual activity results and their transformation into intellectual property. Russian legislation in this sphere is in the process of its formation, but even the existing legislative provision such objects allows to speak about possibility of reaching the level of a civilized market and protection system the innovative potential of the country as the main competitive advantages of the national economy.
