Abstract
Criminal penalties aim at general and special prevention. When sentencing the court makes a conclusion about the necessity of creating special conditions for its achievement, thus determining either deprivation of liberty or not. The degree of isolation of the convict depends on the nature and degree of public danger of the offense, the personality of the convict, his role in the crime and behaviour after committing the crime, including the stage of criminal prosecution.
