DISPUTE RESOLUTION MECHANISM IN COMMERCIAL CONSTRUCTION PROJECT S : A REVIEW

The number and c o mplexity o f c o ntract disputes have increased dramatically in recent years. At the same time, the delays and c o sts ass o ciated with litigati o n have bec o me m o re significant. This secti o n pr o vides an o verview o f dispute res o luti o n meth o ds c o mm o nly used. The increasing trend t o alternative meth o ds o f res o lving disputes suggests a c o nsiderable dissatisfacti o n with the traditi o nal litigati o n pr o cess, at least in certain types o f c o nstructi o n cases. H o wever, it must be emphasized tha t litigati o n is s o metimes, alth o ugh n o t always, still the best s o luti o n t o the parties' pr o blems. In present paper the different literatures are studied t o c o mpare the past studies in this area.
