Abstract

The work is written on the actual topic. In my opinion, the familiar concept of the theory of separation of powers Sh.L. Montesquieu for the legislative, executive and judicial branches of power is already outdated, and in practice is only a formal one. The work is based on the opinions of specialists, as well as scientific and journalistic literature, the views of prominent law theorists, which allows us to analyze this problem and identify solutions. Also in the work it is proposed to allocate the President of the Russian Federation as an independent branch of power, there are objective reasons why it is necessary.
