POSITION OF PRINCIPAL FACT AS A STRUCTUAL ELEMENT OF THE CIRCUMSTANCE IN PROOF IN THE MODERN RUSSIAN CRIMINAL JUSTICE

The work is devoted to the circumstance in proof in modern Russian criminal justice. The possibility and expediency of isolating the principal fact in the structure of criminal procedural proof as the main element of the subject of proof is analyzed, the own point of view and opinions of scientists concerning the issue under consideration is given. It is assumed that the basis for the allocation of the principal fact is the criminal legal category of corpus delicti.
