INTERNATIONAL REGULATION OF THE ADOPTION OF CHILDREN BY SAME-SEX COUPLES

The Institute for the Adoption of Children exists in legislation of all member states of the Council of Europe. There are different views on the principles that should be regulated questions, admission procedures and divergent views on the legal consequences of adoption in these countries. Therefore, the rules of international law are necessary to regulate this sphere. The most acute issue is not only about adopting by couples but especially by the same-sex couples. The article are analyzed enactments of current legislation of Ukraine and foreign countries. In particular, the issue of deprivation of the right to adoption in the aspect of violation of the principle of equality of citizens. The main research base is the European Convention on the Adoption of Children (revised) of 15.02.2011.
