Abstract

In the article is researched the reason of the necessity to create a European Public Prosecutor's Office and the history of its creation. The author also points out the positive aspects of creating this body, paying attention to such a crime against the budget of the European Union, as a fraudulence. The author notes that precisely because of the inability to properly investigate this offense, the EU budget is subject to considerable losses annually, which, as a result, will in future lead to a deficit of the European budget that may occur for the first time in the history of the existence and functioning of the European Union. Bodies currently engaged in fraud investigations are not specialized, which is reflected in the investigation process. While the activities of the specialized body will be aimed at investigating a specific category of crimes against the EU budget, which, most importantly, will increase the effectiveness and effectiveness of counteraction, and such bodies as OLAF, Eurojust and Europol will focus on performing their direct functions. In addition, the author pays attention to the objectives, organization of the activities and structure of this institution of the European Union. Separately is considered the legal status of this body and the rules of its functioning. Also, a separate part of the article is devoted to the headship of the European Public Prosecutor's Office (European prosecutor, deputy and delegated European prosecutors), which refers to the requirements for persons applying for a position in this body, the procedure for their appointment and dismissal, describes in detail the procedure for selecting candidates for management positions in the European Public Prosecutor's Office, as well as the issue of their responsibility. The author justifies his position in accordance with the Regulation, which will regulate the organization of the European Public Prosecutor's Office. That is, the European Public Prosecutor's Office will act as the single body in all EU member states, thus bringing together efforts and forming a unified approach in the field of law-enforcement activity not only at the all-Union level, but also at the national level.
