«Second level» natural law: the problem of «judicial discretion»

Further development of Russian legislation is impossible without determination of the role of the courts in the improvement of existing law. In article conception of «judicial discretion» is presented through then contrast of positivism and natural law. Author justified positive effect of extension of independence of judicial discretion based on a fair resolution of the dispute.
