Abstract

Expertise in the field of computer technology combines features of different expertise β€” both judicial (forensic examination) and non-judicial. The range of subjects of such expertise is quite wide. Consequently, the relationships arising from the regulation of computer science expertise are diverse and subject to legal regulation by various fields of law. However, the legal rules governing the organization and conduct of computer technology expertise in Ukraine, by their nature, reflecting a unique combination of subject matter and method of regulation, are administrative law. The rules of administrative law, in particular, provide for the legal regulation of relations formed in the management of the process of expertise in the field of computer technology. The administrative and legal regulation of computer technology expertise in Ukraine is carried out by a fairly wide range of public administration entities, notably in the area of non-judicial expertise. However, at present, the powers of public administration entities and the actual examination process can be considered standardized only with respect to forensics of computer technologies, while the non-judicial examinations in the said field remain unsettled β€” in particular, the examination process is more or less regulated only with respect to scientific and scientific and technical expertise, and government bodies that designate, conduct, or supervise the examination of expertise are diversified powers, most of which are not specifically aimed at regulating the activities of the expert. Therefore, it should be concluded that the administrative and legal status of public administration in the field of computer technology expertise needs to be improved by defining the clearer rights and responsibilities of the research institutions charged with conducting forensic examination, as well as standardizing the procedures for conducting and the administrative and legal regulation of judicial and non-judicial expertise in the field of computer technology.
