INTERNATIONAL COOPERATION PRINCIPLES IN THE SPHERE OF DEFENCE

Abstract

Modern threats and challenges for the European security system and their influence on the international cooperation principles in the sphere of defence formation and development have been analysed. The part of the basic international law principles for EU country-members cooperation in the sphere of defence have been distinguished. The content of the next international law principles as: the states sovereign equality; honest fulfilment of international duties; peaceful solution of international discussions; non-application of force or threats with force; cooperation, equality and self-determination of peoples and nations; non-interference in the states home affairs; the principle of state borders inviolability; territorial integrity; respect for the rights and the main freedoms of a man have been discovered. The accent on the formation of special principles which reflect the specific features of EU member-states cooperation in the sphere of defence has been done. The own sight on the system of special principles of international law, especially in the defence cooperation has been formed. The next special principles has been offered: cooperation on the base of partnership, equality of rights and mutual benefit, the balance of balance and possibilities, solidarity and partnership principle, the Third World countries interests inviolability principle, the principle of following the laws of country stay in the process of cooperation in the sphere of defence, the security indivisibility principle; the new technologies development encouragement principle; the principle of preference of mutual consultations and talks for settlement of international debates. It has been stated that the basic international law principles and special international law principles which reflect the special character of states cooperation in the sphere of defence are the only interconnected system which supplements and develops each other. The part and significance of the system interaction of the basic and special international law principles for guaranteeing of peaceful and secure conditions for world mankind existence have been proved.
