ON ISSUES CONCERNING PROSECUTION FOR VIOLATIONS OF FIRE SAFETY REQUIREMENTS IN THE ORGANIZATION

In this article, the authors consider the problems of determining some signs of the offense in the field of violation of fire safety requirements in the organization. There is investigated the legislation regulating the prosecution of the guilty person in the distribution of powers between the head of organization and the person responsible for violating fire safety requirements appointed by the head of organization. The mechanism of such appointment is examined. On the basis of the above, as well as the considered judicial practice, legally significant facts are formulated that affect the determination of the objective and subjective side of the offense in the area under study and allow determining the guilt of a person in a bundle: the head of the organization and the person responsible for fire safety.
