The Rights of Stateless Children in Iran and Their Related Legal and Jurisprudential Challenges

Abstract
This article examines the legal and jurisprudential challenges concerning stateless children in Iran. Given the rising number of stateless children due to marriages between Iranian women and foreign men, resulting in these children being deprived of nationality rights, the present study analyzes the shortcomings of existing nationality laws and the rights of these children. This research employs a descriptive-analytical approach, utilizing updated jurisprudential and legal sources as well as statements from the Supreme Leader to identify weaknesses in the current legal system. The findings reveal that the existing laws not only fail to address the needs of these children but also lead to the violation of their fundamental rights. At the conclusion of the study, practical solutions and constructive proposals are put forth to reform the laws and improve the legal status of these children. The research emphasizes that domestic laws must align with international standards to guarantee the fundamental rights of children and enhance their legal status. To mitigate legal and jurisprudential challenges, comprehensive studies and practical recommendations have been provided so that these children may fully exercise their human rights and attain a desirable legal status.
