The Law-domination as the specific feature of Democracy funktioning

This research is devoted to the principal of low-domination significance in the democracy development. In this work the existense of direct correlation between law domination and democracy is proved: as higher is the democracy level in the state, as lesser are limited human rights. The juristic plot of dominating principal from the point of viev of democracy is disclosed. The human right appeared to be more reasonable then the juristic right is, which is given by state. Besides the evollution of law domination principal is in research stated. It was defined, that in the procedure of human right guarantee, carred out by courts, the athmosphere of low domination should be provided in order to avoid it’s unreasonable limitations. In the research is reflected the set of precedent cases, which can illustrate the corectnes of made conclusions.
